Chapter 7 Bankruptcy

Brooklyn, New York Chapter 7 Bankruptcy Attorney

Overwhelming debt caused by credit card expenses, medical bills, job loss, and a downtrodden economy is not uncommon. An unexpected illness or unforeseeable unemployment can result in mounting credit card expenses, an unpaid mortgage, and an inability to recover from debt. If you or your family are suffering from unmanageable debt, you do have options and rights. At The Law Offices of Glenn S. Kessler, I offer strategic guidance and counsel to achieve debt-relief solutions for my clients.

I can help you achieve debt-relief and stop mounting bills, stop creditor harassment, and guide you in taking the first steps toward good credit and financial independence. Contact me today for a free consultation and evaluation.

Most people considering bankruptcy are already out of options. You may have tried to budget, or borrow, or rearrange your finances. Even if you minimize spending and make efforts to pay off bills, financial independence may simply remain beyond your grasp.

As your attorney, my role is to help you explore your options and alternatives before filing bankruptcy. I will help you understand your rights and obligations, and the consequences of bankruptcy, before you take legal action.

What is Chapter 7 bankruptcy?
Chapter 7 is a discharge, or "wiping out," of all your unsecured debt such as medical bills, personal loans, and credit cards. You are able to keep certain "exempt" assets such as a vehicle, retirement accounts, and household goods up to a designated value as well as other, essential assets.

Asset and debt liquidation through Chapter 7 bankruptcy
Chapter 7 is ideal for debtors with few or no assets. To qualify, your income has to be below a certain amount as designated by the new "means test." You may be able to 'buy back' from the bankruptcy trustee any assets that are not exempt. Once approved by the trustee and the court, your debt will be "discharged" (wiped-out) and you will have a fresh start to your financial life.

If you own a small business and never organized a formal business entity (e.g., a corporation, L.L.C., etc.), the debts of the business may be, and are often your personal responsibility. Such 'business debts' can then be discharged through a personal Chapter 7 filing. I can handle both your personal and business debts if you are considering folding your unsuccessful business through bankruptcy.
