What is Chapter 7 bankruptcy?
Chapter 7 is a discharge, or "wiping out," of all your unsecured debt such as medical bills, personal loans, and credit cards. You are able to keep certain "exempt" assets such as a vehicle, retirement accounts, and household goods up to a designated value as well as other, essential assets.
Asset and debt liquidation through Chapter 7 bankruptcy
Chapter 7 is ideal for debtors with few or no assets. To qualify, your income has to be below a certain amount as designated by the new "means test." You may be able to 'buy back' from the bankruptcy trustee any assets that are not exempt. Once approved by the trustee and the court, your debt will be "discharged" (wiped-out) and you will have a fresh start to your financial life.
If you own a small business and never organized a formal business entity (e.g., a corporation, L.L.C., etc.), the debts of the business may be, and are often your personal responsibility. Such 'business debts' can then be discharged through a personal Chapter 7 filing.
